    SIC SEMPER TYRANNIS – Many that follow me on Social Media will have seen my posts that lament what I see to be a despotic judicial branch promoted and protected by my profession that tramples our civil liberties with absolute immunity for their actions. One need look no further than the propaganda from Mr. Frost submitted to the Albuquerque Journal linked below. Unfortunately, we must look further and we must be aware how deep seated this problem is, last night at a function that I attended, when asked what his expectations were for dealing with County Sheriffs (Tony Mace) that refused to enforce his red-flag law, State Representative Damon Ely stated that he expected for the Attorney General to have those Sheriffs removed from office. Think about that for a minute, the response of the hard left progressives to the citizens pushing back against an unconstitutional infringement of their fundamental liberties is to say that they will remove the person elected by the people to protect those rights. I was shocked last night when he said this, but as I looked around the room filled with lawyers and state and federal judges I saw only a few faces in the room that shared my look of horror at this statement. We the people of New Mexico stand at the precipice the same revolution that we are witnessing in Virginia. The tyranny of the government in this state is every bit as real as what our countrymen face in Virginia and what our Founders faced.

    The Ninth Amendment to the United States Constitution states that “The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.” One of those rights retained by the people is the right to confront and abolish a despotic government. Why do I say it is a right retained by the people, I would ask you to consider what our Declaration of Independence, which is the truly foundational document for our Republic, says:

    “We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness. — That to secure these rights, Governments are instituted among Men, deriving their just powers from the consent of the governed, — That whenever any Form of Government becomes destructive of these ends, it is the Right of the People to alter or to abolish it, and to institute new Government, laying its foundation on such principles and organizing its powers in such form, as to them shall seem most likely to effect their Safety and Happiness. Prudence, indeed, will dictate that Governments long established should not be changed for light and transient causes; and accordingly all experience hath shewn, that mankind are more disposed to suffer, while evils are sufferable, than to right themselves by abolishing the forms to which they are accustomed. But when a long train of abuses and usurpations, pursuing invariably the same Object evinces a design to reduce them under absolute Despotism, it is their right, it is their duty, to throw off such Government, and to provide new Guards for their future security.”

    Twice the in that paragraph our Founders recognized a RIGHT to dispose of a despotic government. The first states plainly that “it is the RIGHT of the People to alter or to abolish it, and to institute new Government.” The second time go even further stating that not only is it our RIGHT as people, but it is our DUTY to throw off such Government. Thus, the idea that a tyrannical Attorney General with aid of the judiciary can override the RIGHTS of the people to have a Sheriff, who is doing his DUTY, removed is patently offensive to the very principles upon which our Republic was established.

    So I must therefore urge my fellow New Mexicans and Americans to be wary and gird yourself for the coming battles, tyranny comparable to what lead to our first revolution is upon us, even if it is not already here.

    Art. XX section 1 of the New Mexico Constitution requires that all elected officials in New Mexico take an oath to “support the constitution of the United States and the constitution and laws of this state, and that he will faithfully and impartially discharge the duties of his office to the best of his ability.” It does not say that elected officials can pick and choose which parts of the Constitution to follow (or willfully ignore, such as Article II, Section 6) based on their own interpretation of the Constitution. Pretty god damned simple and easy to understand.

Delusional thinking and You tread too close to advocating the violent overthrow of the government – – etc etc. The idea that elected officials could choose and pick with parts of the constitution to uphold and which to ignore is pure anarchist bull shit.”

    Except that elected officials not only DO pick and choose what parts of the State and federal Constitutions to follow — specifically Article II, Section 6 and the Second Amendment, respectively — but they do so almost with a particular glee about it.
